What should the trust achieve?

A trust for children, an arrangement for a vulnerable relative and a structure intended to continue beyond the founder’s lifetime need different terms. We start with the people to be provided for, the assets involved and the decisions that must remain possible. Your household’s accessible living funds belong in that discussion too.

This produces a clear specialist brief: the objective, existing ownership, family and residence connections, present commitments and the control you want to retain. We compare the proposed trust with simpler arrangements and with the wider asset-structure options before establishment.

Settlor, trustee and beneficiary: the roles that matter

The settlor puts assets into the arrangement; the trustee holds and manages them under its terms; the beneficiaries are the people who may benefit. The rights differ by trust type and wording. In a discretionary arrangement, for example, the trustee’s discretion matters directly to how and when a beneficiary receives a distribution. GOV.UK: trusts and taxes.

We have the professionals explain the decisions in plain language: who appoints or replaces the trustee, who can request money, which powers are reserved, how disagreements are handled and what happens if a key person becomes unavailable. These answers connect the document to practical representation and succession.

UK asset-protection claims and overseas trust law

If you are considering an asset protection trust in the UK because of care fees, the relevant care-funding rules belong in the assessment. In England, deliberate deprivation of assets can lead a local authority to assess you as if you still held the asset or seek recovery from the recipient within the applicable limits. Moving the property into a trust does not remove that question. Care and Support Statutory Guidance, paragraphs 8.27-8.28.

Nevada: the trust-law conditions

A Nevada asset protection trust raises a different, jurisdiction-specific question. Nevada law sets conditions for a self-settled spendthrift trust, including an irrevocable written arrangement, restrictions on required distributions to the settlor and a qualifying trustee. It also addresses transfers intended to hinder, delay or defraud known creditors. Those provisions must be assessed alongside the laws affecting you and the assets. Nevada Revised Statutes, sections 166.015 and 166.040.

Tax connections across borders

For a UK-connected family now living in the UAE, the residence history and location of the assets remain part of the tax brief. We arrange the relevant departure and tax assessment alongside trust law. A Liechtenstein foundation may enter the comparison where its legal form suits the purpose.

Select the people who will carry the responsibility

Trustee selection concerns more than the initial fee. We obtain the proposed service terms, decision process, reporting arrangements, contacts and replacement provisions. We also identify which lawyers and tax advisers cover the trust jurisdiction and the family’s other legal connections.

Each professional receives the information required for their part. The appointments state who drafts, who advises on tax and recognition, who administers and who reports to you. Existing advisers can participate without leaving you to reconcile separate pieces of advice alone.

Establish and fund the agreed arrangement

After you approve the recommendation and costs, we organise documents, signatures, professional instructions and the establishment sequence. Any registration and institution onboarding required for the chosen arrangement is followed through with the responsible provider.

Funding is a distinct step. The asset must be capable of transfer, the receiving institution must accept the arrangement and any tax, lender or contractual consequence must be addressed before the authorised transfer. We bring the confirmations together so that you can distinguish a signed deed from assets actually held under it.

Understand the continuing commitment

The cost comparison includes assessment, drafting and establishment; trustee and administration charges; accounts, tax and reporting work; and charges for distributions, changes or closure where applicable. Assets contributed to the trust are separate from those service costs.

The administration plan states which records you provide, who monitors deadlines and how changes in residence, family circumstances or assets reach the relevant advisers. You receive an agreed contact and reporting process for the life of the commissioned arrangement.

How your family reaches the right person

The handover gives the relevant people a usable route to the trustee or administrator, with the documents needed to establish their identity and role. It explains how a distribution request is made, what information is needed and who decides it under the agreed terms.

Where tangible assets are involved, the legal structure and custody and release arrangements must work together. We also organise the agreed substitute contacts and document access so that a loss of your phone or your availability does not erase the family’s knowledge of the arrangement.

Collaboration and what follows

  1. A professional workspace for coordinating an assignment.

    During the assignment

Keep the legal decision and practical delivery together

We assemble the relevant facts, manage document requests and track the agreed specialist work. Questions about control, tax or recognition are resolved by the responsible professional before the connected implementation step proceeds.

  2. Documents, keys and a phone for a regular readiness review.

    After the handover

Connect the trust to the rest of your preparation

Transfers, custody, powers of representation and family access may be separate parts of the same objective. We connect the work you commission and make the continuing responsibilities clear.
